Agreements & policies

Everything you're asked to read or sign on ClearLot, collected in one place. Our agreements are written in plain language and signed online by typing your full name — ClearLot records your name, the date and time, the document version and your IP address. Each one is versioned, so you always know which text you agreed to.

Consignment agreement

version consignment-2026-10

Signed by sellers when they list a car.

The agreement that puts your car on the ClearLot lot for display and sale, made between ClearLot (“Agent”) and the vehicle owner (“Owner”). You sign it with your listing.

Terms

  • Owner agrees to place their vehicle on ClearLot's premises for display and sale.
  • ClearLot will not negotiate, warranty, or guarantee the sale of any vehicle.
  • Owner affirms they have full legal ownership of the vehicle and the right to sell it.
  • Owner agrees to pay ClearLot a storage/listing fee of $35 per week.
  • Upon sale, ClearLot may charge a transaction facilitation fee of $250 or 3%.
  • Either party may terminate this agreement with 7 days written notice.
  • ClearLot is not liable for theft, damage, or loss unless due to gross negligence.

Disclosures and your signature

  • You certify that you own the vehicle and have the legal right to sell it, and that your condition report and disclosures are accurate to the best of your knowledge.
  • Typing your full legal name signs this agreement electronically. ClearLot records your name and the date and time.

Owner rental & rent-to-own addendum

version owner-rental-2026-10c

Signed by owners who turn on renting or rent-to-own.

Adds renting and rent-to-own to your consignment agreement. You sign it when you turn either on.

What you're allowing

  • You authorize ClearLot to offer your car for rent and/or rent-to-own on the terms you set here.
  • ClearLot reviews renters and applicants, approves or declines them, and hands over and takes back the car at the lot.

Insurance

  • Keep the car insured. Many personal policies don't cover a car while it's rented to someone else, so check with your insurer before turning rentals on.
  • Renters must be 21 or older and show a valid license and insurance card, which ClearLot checks before every rental.
  • Renters may use your car for rideshare or delivery driving. Make sure your policy allows that before turning rentals on; many personal policies exclude it.

Money

  • ClearLot collects rental and rent-to-own payments from renters and records each one.
  • ClearLot keeps 15% of each rental charge (before taxes and the deposit, including late-return days and forfeited cancellation days). It shows on your billing page; the rest is yours.
  • Taxes collected on rentals are remitted by ClearLot and aren't part of your income. Deposits belong to the renter until the car is checked back in.
  • How and when your share reaches you is settled with you in writing.

Changing your mind

  • You can change your terms or turn rentals off from your dashboard at any time. Bookings ClearLot has already approved still go ahead.
  • Your consignment agreement still applies, including the $35 weekly lot fee while the car is on the lot.
  • ClearLot isn't liable for theft, damage or loss unless it's due to ClearLot's gross negligence.

Repair advance addendum (Fix & List / Fix & Rent)

version repair-2026-10

Signed by owners using Fix & List or Fix & Rent, before any repair starts.

If your car needs repairs you can't cover, ClearLot can pay for approved repairs up front and recover the cost from the sale or from rental income. This addendum sets out exactly how that works. Nothing is repaired until you sign it.

What ClearLot pays

  • ClearLot appraises the car, gets a written repair estimate from its partner shop, and shares it with you. Only repairs you approve in writing are done.
  • Repairs are capped at 35% of the appraised expected sale value, so a sale is very unlikely to come up short. If the estimate is over the cap, ClearLot tells you before any work starts.

What you repay

  • The repair cost plus a repair advance fee of 5% of that cost (the "advance"). Nothing is due out of your pocket; it's repaid from your car's sale or rental proceeds.
  • Your consignment agreement still applies: the $35 weekly lot fee while the car is on the lot, and on a sale the transaction facilitation fee of $250 or 3%.

Fix & List (selling)

  • When the car sells, the sale proceeds repay the advance first, then ClearLot's facilitation fee and any unpaid lot fees. Everything left is yours.
  • Before work starts, ClearLot shows you a worked example with your numbers so there are no surprises at the sale.

Fix & Rent (earning)

  • The car goes into ClearLot's rental program under your owner rental addendum, with the rates you set.
  • Your share of rental income (everything after ClearLot's 15%) repays the advance first. Once the advance is clear, you receive your full share of every rental.

If the sale comes up short

  • If sale proceeds don't cover the advance, you owe the difference. The repair cap exists to make this unlikely, and ClearLot tells you the worst-case number before any work starts.

Until you're repaid

  • Before work starts, you can cancel at any time at no cost.
  • Once work has started, the car stays on the ClearLot lot and can't be withdrawn until the advance is repaid or settled.

Your signature

  • Typing your full name signs this addendum electronically. ClearLot records your name, the date and time, this document's version and your IP address.

Car rental agreement

version rental-2026-10e

Signed by renters with every rental request.

The rules for renting a car listed on ClearLot. You sign it with your request. Nothing is charged until ClearLot approves.

Who's involved

  • The owner is the person who listed the car. You are the renter.
  • ClearLot hosts the car at the ClearLot lot named on the listing (Columbia, SC; Aiken, SC; Augusta, GA), reviews requests, hands over and takes back the keys, and keeps the records.
  • ClearLot doesn't warranty the car. Its condition is described by the owner's condition report and disclosures on the listing.

Dates, pickup and return

  • Pick up at 10 a.m. on your pickup date and return by 10 a.m. on your return date, at the lot.
  • Late returns: there's a 60-minute grace period. After that, every started extra day is charged at the car's daily rate, plus the same taxes, and taken from your deposit first.
  • If you need the car longer, ask before your return date. Extensions depend on the car being free.
  • Bring the car back with the same items it left with: keys, documents and accessories.

Driver, license and insurance

  • You must be at least 21 years old on the pickup date.
  • Only you may drive the car unless ClearLot approves another driver in writing.
  • You must hold a valid driver's license that doesn't expire before your return date, and carry auto insurance that covers you driving this car for the whole rental.
  • With your request you type your license number, issuing state and expiration date, and upload photos of the front and back of your license, a selfie holding it, and your insurance card. ClearLot checks them before approving and again at pickup. No license or insurance, no keys.
  • If you drive for a rideshare or delivery platform with the car, you must also carry the coverage that platform requires, for the whole rental.

Price and payment

  • Your request shows the rental price, taxes, the refundable deposit and how you chose to pay. ClearLot works these out from the owner's listed rates.
  • Taxes: the South Carolina rental surcharge (5% of the rental charge, on rentals of 31 days or less) and sales tax (8%). They are shown as separate lines and aren't charged on the deposit.
  • Nothing is charged when you request. After ClearLot approves, you pay online (if offered) or at the lot.
  • The rental, taxes and the deposit must be paid before pickup.

Deposit

  • The deposit is $250 on every rental and is refundable. It's held until the car is back and checked.
  • ClearLot can keep part or all of it to cover: late-return charges, damage during the rental beyond normal wear, miles over any listed allowance at the listed per-mile rate, and tolls, parking or traffic tickets from the rental.
  • ClearLot records what was returned or kept and why, and you can see it in your dashboard.

Using the car

  • No smoking, no towing, no racing or off-road driving, and no driving under the influence.
  • Don't rent, lend or sell the car to anyone else.
  • Rideshare and delivery driving (Uber, Lyft, DoorDash, Instacart and similar) is allowed. Any mileage allowance on the listing still applies, and you're responsible for anything your platform's coverage and your own insurance don't pay.
  • Lock the car and keep the keys with you.

Accidents, damage and theft

  • If there's an accident, damage or theft, call the police when needed and tell ClearLot right away.
  • You are responsible for damage, loss or theft during the rental to the extent your insurance doesn't cover it.
  • You release ClearLot and its staff from liability for accidents, injuries or damage during the rental, except where caused by ClearLot's gross negligence.

Cancelling

  • You can cancel from your dashboard any time before pickup.
  • Cancelling an approved booking is free up to 24 hours before pickup. Inside 24 hours, or if you don't show up, you forfeit one day's rate.
  • Cancelling a request ClearLot hasn't approved yet is always free.
  • Anything you've paid beyond what you forfeit is refunded by ClearLot staff, the same way you paid.
  • ClearLot can decline or cancel a booking before pickup, for example if the car stops being available. Then nothing is forfeited.

Identity verification

  • You authorize ClearLot to verify your identity, driver's license, age and insurance using the details you type and the documents and selfie you upload, including comparing your selfie with your license photo.
  • ClearLot may decline your request, or cancel an approved booking before pickup, if it can't verify any of them or they don't match. Nothing is forfeited then.
  • Only ClearLot staff see your documents, never the car's owner. They're used only to verify you, never sold, and deleted as described in the privacy policy.

Your signature

  • Typing your full name signs this agreement electronically. ClearLot records your name, the date and time, this agreement's version and your IP address.

Rent-to-own acknowledgment

version rto-2026-10d

Signed by applicants when they apply for rent-to-own.

What you're agreeing to when you apply for rent-to-own. This is an application, not the final contract.

This is an application

  • Applying doesn't reserve or sell you the car. ClearLot reviews every application and can approve or decline it.
  • If approved, ClearLot prepares a written rent-to-own contract for you and the owner to sign at the lot before you take the car. That contract governs the deal.

The total cost

  • The total you'd pay is the down payment plus every weekly payment for the full term. The listing shows that number.
  • If the car is also for sale, the rent-to-own total can be more than the cash price. The listing shows both prices so you can compare.

Ownership

  • The owner keeps the title until every payment is made. You own the car only after the final payment and the title transfer.
  • What happens if a payment is missed is set out in the written contract. Read it before you sign.

Who can apply

  • You must be at least 21 years old and hold a valid, unexpired driver's license.
  • With your application you give your date of birth, license number, issuing state and expiration date, your current address and how long you've lived there, and your monthly income and where it comes from.
  • You upload photos of the front and back of your license, a selfie holding it, your insurance card or binder, one to three income documents (pay stubs, gig earnings screenshots or a bank statement) and a bill, lease or bank statement dated within the last 60 days that shows your address.

License and insurance

  • You confirm you hold a valid driver's license and will carry auto insurance on the car for the whole term. ClearLot checks both before approving and again at the lot before you take the car.

Identity verification

  • You authorize ClearLot to verify your identity, driver's license, age, insurance, income and address using the details you give and the documents and selfie you upload, including comparing your selfie with your license photo.
  • ClearLot may decline your application if it can't verify any of them or they don't match what you told us.
  • ClearLot doesn't run a credit check or pull your driving record as part of this application.
  • Only ClearLot staff see your documents, never the car's owner. They're used only to verify your identity and eligibility, never sold, and kept or deleted as described in the privacy policy.

Taxes and fees

  • The payments and total shown are what ClearLot collects for the car. Any tax, title or registration fees due when the title transfers are set out in the written contract.

Payments

  • Payments are made to ClearLot at the lot, or online when ClearLot offers it. Each payment is recorded in your dashboard.

Your signature

  • Typing your full name signs this acknowledgment electronically. ClearLot records your name, the date and time, this document's version and your IP address.

Lot space terms

version space-2026-10b

Signed by anyone renting a stall at the lot.

The rules for renting a stall at the lot for storage or display.

Request and approval

  • A request isn't a reservation. ClearLot confirms the stall and the start date when it approves.
  • The rate is $35 a week or $120 a month per stall, paid at the lot at the start of each week or month.

Your vehicle or items

  • Keep any vehicle in the space registered and insured, and tell ClearLot what you're keeping there.
  • No hazardous materials, no living in vehicles, and no repair work on the lot.
  • Access is during lot hours, and keys stay with you unless ClearLot agrees to hold them.

Liability

  • ClearLot isn't liable for theft, damage or loss unless it's due to ClearLot's gross negligence.

Ending

  • Either side can end the space rental with 7 days' written notice. Amounts already owed still apply.

Your signature

  • Typing your full name signs these terms electronically. ClearLot records your name, the date and time, this document's version and your IP address.

Test drive waiver & release of liability

version waiver-2026-10

Signed by drivers when they book a test drive.

By signing, you request to test drive the vehicle and agree to provide a valid driver's license and proof of insurance, to assume all responsibility for accidents, damages or injuries during the test drive, and to release ClearLot and its staff from any liability arising from it.

Your signature

  • Typing your full name signs this waiver electronically. ClearLot records your name and the date and time.
